booking terms and conditions
Please read the following terms and conditions carefully. These terms and conditions apply to all bookings made through Sunseeker Holidays (“Sunseeker”).
Agency
Sunseeker acts as an agent to sell products on behalf of travel suppliers. Sunseeker is not a travel provider and whilst we exercise due care, we have no control over, or liability for, the services of these suppliers. Your booking will be subject to the terms and conditions of these suppliers. You may request Sunseeker to provide you with the terms and conditions for each travel supplier. You should be familiar with these terms and conditions for each supplier prior to finalising your bookings.
Our service is to arrange and co-ordinate the service offered by third party service providers. We arrange a contractual relationship between you and the provider. We cannot guarantee the performance of the service providers. Sunseeker will not be responsible for any inaccuracies or misrepresentations by any travel supplier. In the event that the services for which you have contracted are not provided, your legal rights are against the provider and not Sunseeker, except to the extent that Sunseeker was responsible for the issue.
You must be over the age of 18 years to place a booking with Sunseeker and have the authority to make travel reservations for your travelling party. Your acceptance of these conditions is on the basis that you warrant that each member of the travelling party is familiar with these terms and conditions.
Prices
All quoted prices are subject to change and cannot be confirmed until payment has been received in full. Your paid booking may also be subject to price changes because of matters outside of our control. Sunseeker will advise of any price changes brought to our attention.
cancellation/ change fees
Cancelled and amended bookings may incur fees which may be up to 100% of the booking price in some cases. The cancellation/change fee will be dependent on the supplier’s terms and conditions. You will be responsible for this fee should you wish Sunseeker to change or cancel your booking. Should you be entitled to a refund, this will be returned to you only when received by the supplier. Sunseeker may also change a cancellation or change fee per booking.
deposits/final payment
Some airfares and services will be payable in full at the time of the booking. Other bookings may require a deposit to secure your booking. This deposit will not be refundable in the event of cancellation. Further deposit amounts may be required and will vary depending on the supplier. Your booking and the price quoted will not be guaranteed until the deposit amount has been received.
You will be advised of your bookings final date for payment. Failure to make the payment by the due date may lead to cancellation of your booking and forfeiture of your deposit. Your travel documents will be issued to you approximately 4 weeks prior to departure.
airlines/ cruiselines
Airlines and Cruise Lines are third party providers and will have different terms and condition to those imposed by Sunseeker. There are many rules and regulations in relation to advance purchase and discounted fares which may provide for substantial cancellation or amendment fees. Fares may also be non-transferable and/or non-refundable. You should ensure that the fare rules are appropriate for your circumstances prior to finalising your booking.
Airlines frequently change their scheduled flight times. It is your responsibility to re-confirm your departure and arrival times prior to your departure. Sunseeker will not be responsible for any changes to flight timings or other charges.
travel documents
You are responsible for holding the correct travel documentation required for your trip. Your name on both your passport/identification and your tickets must match exactly. It is your responsibility to check all travel documents and advise Sunseeker of any errors in the details. You may be denied travel if your documents are not correct. Many countries require entry visas and at least 6 months’ validity on your passport.
travel insurance
Sunseeker strongly advises you to take out comprehensive travel insurance at the time of booking. You should ensure that you will be appropriately covered for loss of deposit, cancellation and additional expenses, medical and repatriation costs, and loss or damage to your belongings. Travelling without appropriate travel insurance coverage can lead to significant personal expense in the event of an injury/incident.
force majeure
Sunseeker will not be responsible for loss or damage incurred because of Sunseeker or any other supplier being unable to provide its contracted services because of a “Force Majeure” event, including severe weather events or other disasters that may lead to cancellation or rescheduling of services. We recommend that you are covered by a comprehensive travel insurance plan to assist you in the case of such events.
travel advice
Sunseeker recommends that you contact the Department of Foreign Affairs and Trade (DFAT) or visit their website www.smartraveller.gov.au for general and specific travel advice directly relating to your travel destinations. The website provides information on health and security, entry and exit requirements and other general information. It is also advisable to register your travel details on their website so that you may be contacted in the event of an emergency.
health precautions
You should ensure that you are fit and well enough to travel and seek advice from a medical specialist where necessary. Some countries have immunisation requirements where you may be denied entry without the required immunisation certificates. You should also seek medical advice in relation to any recommended immunisations and specific health risks of you intended destination. You can also obtain health advice from DFAT at www.smartraveller.gov.au.
limits and liability
Your rights as a consumer are protected under Australian Consumer Law. Subject to these rights, Sunseeker will not be liable for any loss to you because of the failure of a third party provider to provide the contracted travel services as booked. Sunseeker will not be liable for any injury, death or other loss caused either directly or indirectly by any service provider in the course of providing such services. Sunseeker will not be liable for any loss or inconvenience due to the delay, cancellation, rescheduling or otherwise, of any services provided by a third party supplier.
privacy
Sunseeker is committed to protecting your privacy and personal information in accordance with our Privacy Policy. We use the information we collect about you to maximise the services that we provide to you. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles. We will not provide your information to a third party unless it is necessary to for the purposes of facilitating your travel bookings.
your responsibilities
- You warrant that you are over the age of eighteen (18) and have sufficient funds to pay for the travel services.
- You have read our T & C’s and if booking for third parties have conveyed these T & C’s to them.
- You have read the T & C’s of any third-party service providers and agree to be bound by those.
- You are responsible for checking the accuracy of all documents provided to you.
- You are responsible for contacting the airline at least seventy-two (72) hours prior to travel.
- You warrant and acknowledge that you have accessed the Smarttraveller website for any specific enquiries in relation to your intended destination.
